I think the recent legal fight between the Scottish government and the Scottish information commissioner over legal advice regarding scottish Independence and the EU is an excellent example supporting the need for presumption of transparency.

Salmond and the Scottish Government refused to say if there was legal advice on Scotlands post independence situation in Europe. The Information commissioner tried to force publication of the advice. the final result: The Scottish government revealed that they had no advice while lamenting that they had been legally obliged not to let anyone know if there was or was not any advice. So hundreds of thousands of pounds were spend on a legal battle chasing advice that did not exist just because the Government was not supposed to say if there was any advice.
